Terms for Participants


Maschinenbau-Institut GmbH ("the Organizer")

The following terms and conditions shall apply to the contracts between the Organizer and the individual registrant ("Contract Party"). They apply to the exclusion of any other provision or rule. Deviating terms and conditions are inapplicable.


1 Registration:
We recommend to register well in advance. The participation/exhibition fee is payable up until the start of the event at the latest, however not before you receive the invoice.


2 Liability:
The Organizer in the fulfillment of its contractual obligations shall be liable only for its own intentional or grossly negligent acts or any such acts committed by its legal representatives and/or agents. The Organizer shall be fully liable in the case of a breach of a fundamental condition of contract, if attributable to slight negligence, however, limited to the reasonably foreseeable damage which is intrinsic to the contract.

The liability of the Organizer or its statutory representatives or of its agents for damage related to culpable injury to life, limb or health as well as with respect to their adherence to guarantees promised remains unaffected.


3 Cancellation:
The Organizer plans the resources to be made available on the basis of the registrations received. When speakers, event premises, catering, etc. are booked, the Organizer must make binding commitments well in advance to ensure a high level of quality at reasonable cost. This is why registrations for an event are final and binding. If a registration is withdrawn, however, the following cancellation conditions apply:

A cancellation shall be made in writing to be valid.

The Organizer charges €100 + 19% VAT as a processing fee with respect to cancellations received up until 31 July 2016. Substitute attendees can be designated any time free of charge.

Cancellations received between 1 August 2016 and 31 August 2016 shall be subject to a cancellation fee in the amount of 70% of the regular participation fee plus 19% VAT.

For cancellations received on or after 1 September 2016 the participation fee, or parts thereof is/are non-refundable. The participation fee shall then be payable in full. The Contracting Party is entitled to prove that the damage incurred by the Organizer is less.


4 Changes in the schedule:
The Organizer reserves the right to change the original schedule in exceptional circumstances. Should the event be cancelled for previously unforeseeable reasons, the Contracting Party shall be informed forthwith. In such a case, the Organizer’s liability shall be limited to paying back the fees already received. Furthermore, Art. 2 shall apply.


5 Sound and image recording:
Audio and image recording during an event shall require the prior written approval of the Organizer. The same shall apply mutatis mutandis for any subsequent use of sound and image recordings made at any event. The Contracting Parties agree that image and sound recordings of their person, made by the Organizer, can be used free of charge.


6 Event documents/documentation:
A third party cannot be granted the right to use event documentation and/or training documents, whether against valuable consideration or not, without the prior written consent of the Organizer.


7 Data protection notice/declaration of consent:
Data of the Contracting Party is stored and/or processed within the strict limits imposed by the German Federal Data Protection Act. Data is stored and/or processed solely for the purpose of implementing and accounting for the registration as well as for providing the Contracting Party with information on the range of services offered by VDMA e.V., EFRC e.V. and Maschinenbau-Institut GmbH.

Unless otherwise indicated by the Contracting Party, the VDMA e.V., EFRC e.V. and Maschinenbau-Institut GmbH will thereupon inform the Contracting Party by surface mail, email, fax or telephone about their services and upcoming events. The Contracting Party may withdraw its consent any time: Maschinenbau-Institut GmbH, Lyoner Str. 18, 60528 Frankfurt/M., Germany or mbi@vdma.org.


8 Severability clause:
If a provision of this agreement is or becomes wholly or partially invalid, the validity of the remaining provisions of the agreement shall not be affected.


9 Venue/applicable law:
The venue for all disputes arising out of this contract between the Organizer and the Contracting Party shall be the seat of the Organizer, Frankfurt am Main, Germany, provided that the Contracting Party is a business person, a legal person under public law or a special fund governed by public law.


The law applicable shall be the law of Germany. The official conference language will be English.
